There are two bills pending in the Arizona legislature that would severely hurt injured in Arizona. House Bill 2367 would essentially prevent injured workers from choosing their own doctors when injured on the job. House bill 2365 would institute "evidence based medicine" which basically establishes treatment recommendations in accordance with a national guidelines. This essentially is another way for insurance carriers to direct medical care for the injured worker. Both of these bills are very bad for Arizona. Believe it or not, myofascial injuries can mimic symptoms that are similar to intraspinal injuries, such as herniated discs and stenosis (narrowing of the spinal canal). The most common forms of treatment for these injuries are trigger point injections and physical therapy. Very frequently these types of injuries are coupled with more serious structural type conditions, and the myofascial issues take a back seat to the structural issue. Thus, it's important to complain to your doctor(s) about all conditions that are bothering you, and make sure they are documented. This is an outright lie, unless the employer is self-insured under the worker's compensation act (and there are exceptions here too). Thus, if you are an IW that does not care for the doctor you are treating with under your worker's compensation claim, know that you have a right to change physicians. Please free to contact Don Fendon or myself and we will be glad to consult with you on this issue and any other worker's compensation and/or Social Security Disability questions you have. For example, if someone suffered a primary left knee injury which has received the majority of the treatment, but the right knee was also injured in the accident, and has not received any or little treatment. Another scenario, is when the left knee injury is so bad that the right knee is injured by overuse of the left extremity. Insurance carriers will fight to exclude secondary injuries such as mentioned above. That is why it is important that the injured worker makes sure his or her doctor documents his or her complaints on the secondary injuries. The injured worker should make sure these complaints are documented from when he or she initially complained of the problems -- the earlier the better! If you have further questions about this issue or any other Arizona worker's compensation issues, please contact Fendon Law Firm, P.C. - 602-256-2000, or toll free 800-229-3880.

The Two Most Important Things To Do When Hurt on the Job

The majority of the people we speak with who have had their worker's compensation claims denied haven't done one or both of the following things: 1) filed a claim for worker's compensation benefits in writing promptly after the person is hurt; 2) failed to seek prompt medical attention after being hurt on the job.

The majority of worker's compensation cases are accepted in Arizona when the injured worker meets both of these requirements.

Getting prompt medical treatment may require a person to visit an urgent care facility or the emergency room. To file a claim for worker's compensation benefits, the injured worker would need to contact the Industrial Commission of Arizona (602-542-4661, or http://www.ica.state.az.us/workersCompensation/index.html).

We'll check in again soon with more tips on navigating the Arizona worker's compensation system.

Fendon Law Firm, P.C.
800-229-3880
602-256-2000
