Things to do if injured on the job

Workers comp tip of the day -- if you are injured on the job, the three most important things you should do are to file a claim with the Industrial Commission (602-542-4661), report the injury in writing to your employer - an email will work, and see a doctor right away. Constructive discharge

Employment Law Tip of the Day - You don't have to be fired to have a potential claim for wrongful termination against your employer. Constructive discharge occurs when working conditions are so bad that a "reasonable person" would feel compelled to resign. Constructive discharge is actually covered in the Arizona Revised Statutes at ARS 23-1502. Hearings for SS cases

Social Security Tip of the Day - Subpoenas are allowed in SS cases. However, they are not routinely issued. The reasons are that they are seldom requested; attorneys often request subpoenas when they really don't need them, and judges are concerned with what will happen if they are ignored. Equal Pay Act

Employment Law tip of the Day - Equal Pay Act - this Federal law prohibits employers from paying workers of one sex at a wage rate different from that paid workers of the opposite sex for equal work. It applies only to sex discrimination. The exceptions to the rule are wage differentials per a seniority system, merit system, systems that measure earnings by quantity/quality of production, or for any other reason unrelated to sex. FMLA

Employment Law Tip of the Day - Family Medical Leave Act (FMLA) - this is a Federal regulation that allows certain employees up to 3 months of unpaid leave. During the leave, the employee's health insurance benefits are to be kept in effect. Also, the employee should be reinstated to their former job, and rate of pay if possible.
